MISSION STATEMENT

· Provide direct support to the Executive to improve the executive’s productivity allowing him to perform more, higher value work.

  • Attendance at firm huddle every Monday at 8:00 am

MISSION STATEMENT


The Case Manager collaborates with all attorneys to provide them with information on assigned personal injury cases. We treat our clients with compassion and advocate for them by maximizing compensation caused by wrongful actions of others. Our goal is to ensure our clients are satisfied and know Parnall Law has stood up and fought for them by giving them a voice.


RESPONSIBILITIES


  • Partner closely with our 10 passionate attorneys
  • Following up with clients or insurance providers/carriers by phone, email, or mail
  • Ensuring all liability, UIM, and Med Pay claims are opened
  • Determine when to open or not to open health insurance subrogation claims
  • Open all Medicare subrogation claims
  • Complete analysis of case
  • Review and modify, update or edit demand packages
  • Collaborate with billing analysts to verify balances and coordinate benefits
  • Partner with settlement paralegal on settlement issues including reductions on subrogation claims and/or provider balances.
  • Attending weekly meetings

  • Direct calls to the right person with as much efficiency and diplomacy as possible.
  • Weed out unwanted callers.
  • Help create a positive team environment by communicating with each team member to ensure all callers and visitors are given prompt attention.
  • Provide prompt and courteous service for every caller and visitor.
  • Become familiar with clients and callers to help document the case and handle client issues that arise, whether the paralegal can help or not at that moment.
  • Posting all messages in SmartAdvocate promptly and accurately.
  • Helping the Case Managers/Paralegals with data entry and other office tasks when not receiving calls or visitors.

Housekeeping

  • Make sure water and coffee is available
  • Clean/organize front area, copy room and conference room

Correspondence

  • Get mail from front door

RESULTS/OUTCOMES (What you must get done).

  • Obtain accident reports and incident reports within 15 days of the file being opened.
  • Complete all paralegal and attorney requests accurately and promptly.
  • Posting all case information, and litigation information, accurately in Smart Advocate.
  • Proportionately contribute to overall client satisfaction and firm revenue goals.
  • Achieve 95% positive reviews.


DUTIES/RESPONSIBILITIES

  • Entering all party information from the reports collected, into Smart Advocate.
  • Send out IPRA (public records requests) for 911 calls, CADs, police photos, interviews, lapel, bar citations, or any other IPRA requests needed.
  • Provider follow up calls and emails until all evidence is in. Interaction with various public agencies for IPRA requests, reports or other data needed.
  • Take interviews of witnesses and summarize same
  • Photograph crash sites
  • Summarize evidence noting key issues.
  • Keeping the paralegals and/or attorneys appraised of all efforts and complications.
  • Background searches on torts or clients including: nmcourts.gov, social media, and firm background tools.
  • Property address search
  • License info and research
  • Google maps of relevant sites
  • Any task assigned by paralegal or attorney

  • Reconcile all bank statements monthly
  • Audit and follow up on all operating and trust unpaid checks quarterly
  • Sales Taxes – verify and pay gross receipts taxes monthly.
  • Holding account: update daily (Accounts Payable, Credit card (Spark), Sales Tax Payable, Payroll, etc.
  • Maintain firm credit cards (Spark, Capital One and American Express) including: download credit card transactions weekly and code; and reconcile credit card statement monthly
  • Payroll:
  • Finalize Bonus spreadsheet twice monthly
  • Post payroll payments to QB semi monthly after payroll.
  • Post 401K payments to QB semi monthly
  • Positive Pay: Daily upload of all checks issued

    RESULTS / OUTCOMES (What you must get done.)

    • Attend weekly firm wide huddle every Monday morning at 8:00
    • Attend daily team mini huddle Tuesday through Friday at 8:00 am
    • Attend weekly Friday calendar meeting at 8:00 am
    • Meet with Lead attorney weekly to go over metrics/kpis
    • Settle 95% of all cases within the evaluation amount.
    • Move cases from Pre-Litigation to Litigation stage within 90 days of negotiation, if case has not settled.
    • Ensure we can take our full fee on 95% of all cases (meaning we don’t have to reduce our fee because there is not enough money to pay all providers, subrogation claims, liens, and client).
    • Maintain a Good Call Conversion Rate of 95% or higher (signing wanted cases)
    • Achieve 95% positive reviews.

    DUTIES / RESPONSIBILITIES

    General

    • Timely review, edit, and approved all correspondence drafted by CM/Paras.
    • Be available 8 hours per day, if not out of office at meetings, hearings, depos or trial.
    • Show consistent growth in the complexity and value of cases you are settling.

    Intakes

    • Meet with clients to evaluate case for representation
    • Take all facts pertinent to liability, damages, coverage
    • Show compassion
    • Posture case by articulating client and office action items
    • Explain representation agreement and have sign

    Investigation

    • Evaluate needed investigation
    • Communicate with paralegal about what investigation tasks need to be completed
    • Determine if UM/UIM applies
    • Posture the case for trial or negotiations

    Negotiation

    • Meet with clients to evaluate and get authorization to negotiate
    • Meet with Lead or Full Value Committee to set firm evaluation amount
    • Negotiate with adjusters and keep client informed
    • Prepare case for mediation
    • Speak with adjusters, build and maintain negotiation relationships, aggressively negotiate and/or posture cases with adjusters where appropriate.
    • Make determination about filing suit or further negotiations
    • If filing suit, prepare client for litigation process

    Litigation

    • Draft pleadings and discovery for lawsuits
    • Compose discovery responses
    • Compose discovery requests
    • Prepare case for trial, arbitration, and/or mediation

    • Draft and file complaints within 30 days of case being transferred to LIT 00.
    • Send out service of process within 15 days of filing complaint.
    • Accomplish service of process within 30 days of sending out service.
    • Ensure that a scheduling conference has been requested within 30 days of all defendants filing an answer to the complaint (unless the case is valued at more than $100K and attorney has chosen not to request yet).
    • Ensure that scheduling hearings are set within two months of the request.
    • Calendar all scheduling order items within 5 days of receipt of the scheduling order.
    • Schedule mediations within 60 days of moving a case to LDD (Litigation, Discovery, Depositions).
    • Providing telephonic client updates every 6 weeks and having 10 or less outstanding updates at any given time.
    • Ensure overdue tasks never exceed 50.

    DUTIES / RESPONSIBILITIES

    • Attend Transition to Litigation meetings with client and Case Manager.
    • Speak to adjusters, defense attorneys, others involved in litigation.
    • Update client with copies of relevant file materials.
    • Work with legal assistant to e-file and e-serve court pleadings
    • Be familiar with state, local and federal rules for every jurisdiction in we practice in
    • Post all costs including expected costs that we have not been invoiced for (mediation, depositions, expert fees, etc.)
    • Draft and serve subpoenas
    • Compose discovery requests, answers / responses

    · Creating and maintaining a discovery index identifying production of all parties, by bates stamp numbers.

    • Review defendant discovery responses/Defendant deposition transcripts for follow up discovery
    • Update case analysis within one week of receiving Defendant's discovery answers with Defendant's policy limits.
    • Set Depositions (Request witness fee, if necessary)
    • Create motion/mediation and arbitration/exhibit binders
    • Be up-to-date with each case and work with case managers/ legal assistants to complete the background check/asset check on all Defendants and background check on clients.
    • Complete all attorney assignments in a timely manner.
    • Draft correspondence, pleadings, discovery for attorneys, save/name all documents in SmartAdvocate in accordance with Naming Protocol.
    • Calendar all case information pursuant to the calendaring protocol.
    • Answer backup calls
    • Perform backup intake calls in accordance with intake protocol.
    • Work with all staff assigned to your cases to move the case to a desired conclusion.
    • Posting all case information, case dates, and litigation information, in SmartAdvocate.
    • Prepare for trial (schedule witness statements, exhibits, UJIs, etc.)
    • Attend trial
    • Follow and maintain all firm policies and procedures.
    • Proportionately contribute to overall client satisfaction and firm revenue goals.
